DOT Consortium Drug & Alcohol Testing Program

Stay DOT Compliant with USDOT Compliance

The Federal Motor Carrier Safety Administration (FMCSA) requires CDL drivers and motor carriers operating commercial motor vehicles (CMVs) to participate in a DOT-compliant Drug and Alcohol Testing Program.

At USDOT Compliance, we help carriers, owner-operators, and transportation companies stay compliant with FMCSA regulations through our complete Consortium Drug & Alcohol Testing Program.

Our services are designed to simplify compliance while helping keep your drivers, business, and the public safe.

FMCSA Clearinghouse Requirements

The FMCSA Commercial Driver’s License (CDL) Drug and Alcohol Clearinghouse is a secure federal database that contains real-time information regarding violations of the DOT drug and alcohol testing regulations under 49 CFR Parts 40 and 382.

The Clearinghouse allows employers to identify drivers who are prohibited from operating a commercial motor vehicle due to drug or alcohol violations.

FMCSA Clearinghouse Requirements Include

  • Employers must perform a Clearinghouse query on all prospective CDL drivers before allowing them to operate a CMV.
  • Employers must conduct annual Clearinghouse queries on all currently employed CDL drivers.
  • Employers must report violations related to drug and alcohol testing regulations.
  • Drivers who violate DOT drug and alcohol rules must complete the return-to-duty process before operating a CMV again.

Violation records remain in the Clearinghouse for five years or until the return-to-duty process has been successfully completed, whichever is later.

FMCSA Drug & Alcohol Testing Program

Drivers operating commercial motor vehicles requiring a Commercial Driver’s License (CDL) must participate in a DOT-compliant random drug and alcohol testing consortium.

Under FMCSA regulations, a CMV operator is any individual who operates a commercial motor vehicle in interstate or intrastate commerce and is subject to CDL requirements under 49 CFR Part 383.

Who Is Required to Participate?

You are generally required to participate in the FMCSA Drug & Alcohol Testing Program if your vehicle:

  • Has a Gross Vehicle Weight Rating (GVWR) of 26,001 pounds or more
  • Is designed to transport 16 or more passengers, including the driver
  • Transports hazardous materials requiring placards under federal regulations
  • Includes a towed unit with a GVWR exceeding 10,000 pounds and a combined weight over 26,001 pounds

Owner-operators are also required to enroll in a DOT-compliant consortium even if they are exempt from supervisor training requirements.

FMCSA Supervisor Training Requirements

Under 49 CFR 382.603, supervisors of CDL drivers must complete mandatory DOT supervisor training.

This training includes:

  • 60 minutes of alcohol misuse training
  • 60 minutes of controlled substance abuse training

The purpose of this training is to help supervisors recognize signs and symptoms of drug or alcohol misuse and determine when reasonable suspicion testing may be required.

If your company operates commercial vehicles requiring a CDL and employs one or more drivers, DOT Supervisor Training is required.

Required Types of DOT Drug & Alcohol Testing

Commercial drivers are subject to multiple types of DOT-required testing to maintain compliance with FMCSA regulations.

Pre-Employment Testing

Drivers must complete a DOT drug test before performing safety-sensitive duties.

Random Drug & Alcohol Testing

Drivers enrolled in a consortium are subject to unannounced random testing throughout the year as required by FMCSA regulations.

Post-Accident Testing

Drivers involved in qualifying accidents may be required to complete drug and alcohol testing following the incident.

Reasonable Suspicion Testing

If a supervisor observes signs of drug or alcohol use, the driver may be required to undergo immediate testing.

Return-to-Duty Testing

Drivers returning to safety-sensitive duties after a DOT violation must complete return-to-duty testing before resuming work.

Follow-Up Testing

Drivers who have completed the return-to-duty process may be subject to ongoing follow-up testing as directed by a Substance Abuse Professional (SAP).
